NOTICE TO ALL KNOWN AFFECTED PERSONS (“Affected Persons”) OF ZIZWE FUELS (PTY) LTD WITH REGISTRATION NUMBER: 2017/522416/07
1. NOTICE OF THE COMMENCEMENT OF BUSINESS RESCUE PROCEEDINGS
AND OF THE APPOINTMENT OF THE BUSINESS RESCUE PRACTITIONER IN
TERMS OF THE COMPANIES ACT 71 OF 2008, AS AMENDED
1.1. You are hereby notified that the Company commenced Business Rescue
Proceedings on 26 November 2025 in accordance with Section 129 of the
Companies Act 71 of 2008, as amended (“Companies Act”) by way of
voluntary resolution filed by the board of directors, and that Mr Delmaine
September was be appointed as the Company’s business rescue
practitioner.
1.2. The effective date of the Company’s business rescue proceedings is
accordingly 26 November 2025.
1.3. In accordance with the requirements of Section 129(3)(a) of the Companies
Act, read with Companies Regulation 123(2), the following documents are
published herewith:
1.3.1. the notice to commence business rescue proceedings (form CoR
123.1);
1.3.2. the resolution passed by the board of directors of the Company; and
1.3.3. a sworn statement of the facts relevant to the grounds on which the
board resolution was founded.1.4. 1.5. 1.6. A form CoR 123.2, being a Notice of Appointment of Business Rescue
Practitioner(s) was filed with the CIPC in terms of section 129(4)(a) of the
Companies Act as read with Companies Regulation 123(3).
We await receipt of the CoR 123.2 from the Commission.
Please note that the aforesaid documents, as well as all other notices
relevant to the commencement of business rescue proceedings of the
Company, will also be available on the Company’s website at:

2. CLOSING REMARKS
2.1. We trust that with your assistance and co-operation the Company can be
rescued, within the meaning of section 128(1)(h) of the Companies Act, in
a manner that will balance the rights and interests of all Affected Persons.
